The competency level of the Dutch subdistrict court (sector kanton), which is currently EUR 5,000, will be raised to EUR 25,000 with effect from 1 July 2011. In addition, the subdistrict court will also have competence to handle all cases in the consumer-sale category (article 7:5 of the Dutch Civil Code – “Burgerlijk Wetboek”) and cases involving credit transactions as laid down in the Consumer Credit Act (“Wet op het Consumenten Krediet”). Labour , rental and trade name issues are currently handled (some exclusively) by the subdistrict court. Although it is highly recommendable, it is not necessary for plaintiff and defendant to be represented by a bar admitted lawyer (“advocaat”) in cases before the subdistrict court.
