Goodwill compensation at the end of a distribution agreement?

The question whether distributors are entitled for goodwill compensation upon termination of the agreement, is analysed by Lejla Lagumdzija, lawyer at VMW Taxand. She wrote an article about it, which is published in the newsletter of AIJA, the International Association of Young Lawyers.

The article is about getting deeper into the thought to accept a goodwill compensation at the end of a distribution agreement. Dutch Courts are reluctant to accept such goodwill compensation as a general principle. However, many authors in the literature disagree and plea for goodwill compensation as a general principle.
