Pledge of insurance broker's portfolio

Although it is common practice that the portfolio of an insurance broker is pledged as security for the broker’s obligations towards its financiers, there is no case law showing that such a pledge is legally valid and enforceable. In a recent contribution to the Dutch Insolvency Law Review (Tijdschrift voor Insolventierecht), Godfried van Berkel explains why the closed system of Dutch property law does not allow the insurance broker’s portfolio to be pledged.
